A native of Long Island, New York, Scott joined the U.S. Army Judge Advocate Corps in 1998 after earning a Juris Doctor degree from The Catholic University of America Columbus School of Law (Catholic Law), in Washington, D.C. As an active duty Army Judge Advocate, Flesch served in a variety of assignments including as a Trial Attorney with the Contract Litigation and Intellectual Property Division (KLIP) of the U.S. Army Legal Services Agency (USALSA). In 2005, Flesch left active duty and joined the Army JAGC Reserves. At the same time, he accepted a civilian Trial Attorney position in KLIP, known formerly as the Contract and Fiscal Law Division (KFLD) and the Contract Appeals Division (CAD) before that. As a civilian Trial Attorney, Flesch litigated disputes before the Armed Services Board of Contract Appeals (ASBCA), as well as bid protests before the Government Accountability Office (GAO) and the U.S. Court of Federal Claims (COFC). Flesch also managed a procurement fraud portfolio including the administration of five administrative compliance agreements between the Army’s Suspension Debarment Official and various corporations.
In May 2011, Flesch was selected as Chief, Bid Protests in KLIP. In that role, he was responsible for the litigation of protests filed against a multitude of Army and DoD agencies at the GAO and the COFC. Flesch technically supervised, led, trained, and mentored military and civilian trial attorneys in defending protests. From 2011 through 2019, Flesch was responsible for the litigation of over 1900 GAO cases and over 170 COFC protests on behalf of various Army and DoD clients.
In January 2020, the Judge Advocate General of the U.S. Army appointed Flesch to serve as the next Army Chief Trial Attorney (Army CTA). The Army CTA serves as the authorized representative of the Secretary of the Army with sole authority and responsibility for the conduct and control of litigation of contract disputes for all Department of the Army cases docketed with the Armed Services Board of Contract Appeals and the COFC, with the exception of appeals originating from the U.S. Army Corps of Engineers valued under $3 million. As the Army CTA, Flesch oversees the litigation activities of 36 military and civilian trial attorneys and paralegals who are assigned to KLIP.
Flesch also earned a Bachelor of Arts degree in Politics from Catholic University. In addition to his work assignments, Flesch has served in a number of elected and appointed positions within several legal associations including service as a Council Member on the American Bar Association, Public Contract Law Section (PCLS), and on its Nominations Committee. He served as a Co-Chair of the PCLS’ Bid Protest Committee (BPC) and now serves as a Vice Chair on the Contract Claims and Disputes Resolution Committee. Flesch serves as a Member of the Board of Governors for the Boards of Contract Appeals Bar Association. He is a graduate of OPM’s Federal Executive Institute’s Leadership in a Democratic Society Course and continues to be an Adjunct Faculty member at Catholic Law where he has taught for the last 18 years. Flesch and his bride, Amy, have two boys and live in Vienna, Virginia."
