On May 2, 2022, Mark Rienzi, Director of the Center for Religious Liberty and Professor of Law at Catholic Law, and President of The Becket Fund for Religious Liberty, was a featured guest on an episode of Gray Matters. Gray Matters is the C. Bowden Gray Center for the Study of the Administrative State Podcast hosted by Jennifer Mascott. The episode’s panel discussion included attorneys Nathan Lewin, Erin E. Murphy, and Marc D. Stern, in addition to Rienzi, who talked about upcoming religious liberty cases before the U.S. Supreme Court. Former Assistant Attorney General Steven A. Engel acted as moderator. The panelists discussed the potential impact of Supreme Court rulings in those cases in addition to whether current approaches to protecting religious liberty are adequate to navigate contemporary challenges.

“What’s the message the Court is trying to give? I’d predict it’s a message of: ‘stop relying on [Lemon v. Kurtzman] so much.’ [...] The Court can really go a long way to rip out the bad effects of Lemon if in these cases it tells the government to get out of that bad, 70s era way of thinking about the Establishment Clause."
