Catholic Law Professor Elizabeth Winston was quoted in a recent Wind Power Monthly article, “Could SGRE’s IP court battle with GE have implications for the entire wind industry?” The article explores the federal court case between Siemens Gamesa Renewable Energy (SGRE) and General Electric (GE) over intellectual property rights. Winston commented on the impact of patent law in regards to wind turbines off the coast of the United States on the Outer Continental Shelf (OCS).

Asked how the OCS ruling could impact offshore wind projects in states other than Massachusetts, she said: ‘A Massachusetts district court decision is not binding on a district court in another jurisdiction, but may be found to be persuasive by another district court.’”
