The Catholic University of America Columbus School of Law's location in Washington, D.C., allows for law students to experience firsthand the process behind some of the decisions which lay the groundwork for future legal decisions. On November 7, Professor Marshall Breger took his Administrative Law class to the United States Supreme Court to hear the oral argument in Securities and Exchange Commission v. Cochran.
The question presented was: Did Congress through the Securities Exchange Act, strip district courts of jurisdiction over constitutional challenges to the Securities and Exchange Commission’s structure, procedures, and existence? The students had read the underlying case and briefs before the trip so they were well prepared. Two of the students in the class noted:
