Stacy L. Brustin, Professor and Director of the Immigrant and Refugee Advocacy Clinic at The Catholic University of America Columbus School of Law (Catholic Law), published an opinion piece in The Hill on June 27, 2023. Professor Brustin’s op-ed, entitled “Biden Is Making a Shambles of the Right to Seek Asylum,” detailed her trip to the southern border, during which she visited an overcrowded border encampment in Mexican city of Matamoros and interviewed asylum seekers at the Port Isabel Processing Center near Brownsville, Texas. The article additionally examines the Biden administration’s related border plan which recently replaced Title 42, an emergency regulation designed to stem border crossings during the COVID-19 pandemic.

Biden Is Making a Shambles of the Right to Seek Asylum

The Biden administration recently announced that its border plan is “working as intended.” It was referring to Biden’s restrictive new policies that took effect with the ending of Title 42, the COVID emergency health regulation that allowed the U.S. to turn away adult asylum seekers at the southern border.
What the administration failed to acknowledge is that these restrictions undermine President Biden’s promise to end inhumane Trump-era border policies. Instead he is making a shambles of the right to seek asylum.
